Should you be concerned about a workers compensation denial

Suffering an on-the-job injury can be frustrating on many levels. Not only do you have to deal with the aftermath of your injury, but you may not be able to return to work right away.

If you find yourself in this position, it’s important to take care of your health above all else. Along with this, learn more about the workers’ compensation system, as you may be able to receive benefits until you can return to your job.

While you hope it doesn’t come into play, you may find yourself facing a workers’ compensation claim denial. There are many reasons this could happen, such as:

  • You did not report the injury on time
  • You did not file a claim on time
  • Your employer is disputing your claim, such as arguing that you were injured at home and not at work
  • You did not receive the appropriate type of medical treatment after the accident

Since there is so much that can go wrong, it’s a good idea to collect as much evidence as possible. Also, don’t hesitate to report the accident and receive medical treatment.

If you receive a workers’ compensation denial letter you have two options: let it go and hope for the best in regard to your recovery, or file an appeal.

If you’re convinced you should receive benefits, follow through with the appeals process. This will require some work on your part, but it will move you closer toward the benefits you deserve. As frustrating as it may be, you should never give up when it comes to protecting your legal rights.
